OFFICIAL CONTEST RULES

DECK YOUR STREET WITH TIM HORTONS® CONTEST

No purchase necessary to enter or win. Making a purchase will not increase your chances of winning. Void where prohibited. This contest is open to Canadian residents only, and is governed by Canadian law.

1.     CONTEST PERIOD:

The Contest begins on Wednesday, December 1, 2021 at 06:00:00 AM Eastern Standard Time (“EST”) and ends on Tuesday, December 7, 2021 at 11:59:59 PM EST (the “Contest Period”).

2.     ELIGIBILITY:

The Contest is open to residents of Canada who are located in Canada and, at the time of entry and if applicable awarding of the Prize (defined below), have (i) reached the legal age of majority in their province or territory of residence (an “Entrant”), or (ii) are sixteen (16) years of age or older, but under the legal age of majority in their province/territory of residence (each, a “Minor”) and have permission from their parent/legal guardian (a “Parent”) who has agreed, on such Minor’s behalf and on his/her own behalf, that each of them will be bound by these Official Rules and Regulations (the “Official Rules”). Despite the aforegoing, employees, representatives or agents of: Tim Hortons Advertising and Promotion Fund (Canada) Inc. (the “Sponsor”), its parent, affiliated and related companies, their respective advertising/promotion agencies, the Contest administrators, Tim Hortons franchisees/licensees, the Contest Administrator  or any other service providers related to the Contest (including any other person living in the same household of such person whether related or not) (collectively, the “Contest Parties”). Groups, clubs, organizations, businesses and commercial/non-commercial entities cannot participate collectively. Entrants must be individuals.

NOTE TO MINORS: The Sponsor reserves the right, in its sole and absolute discretion, on a random audit basis or at any time and for any reason, to contact a Minor’s Parent for the purposes of verifying his/her: (i) agreement (on his/her own behalf and on behalf of the Minor) to be legally bound by these Official Rules; (ii) consent to the Minor’s participation in this Contest; and/or (iii) consent to the collection, use and disclosure of the Minor’s personal information for the purpose of administering the Contest (see below for further details). Failure of a Minor’s Parent to complete any such required verification to the complete satisfaction of the Sponsor within the timeline specified by the Sponsor may, in the sole and absolute discretion of the Sponsor, result in disqualification of the applicable Minor.

By entering the Contest, each Entrant acknowledges and agrees that the Sponsor and/or the Contest administrator is fully responsible for the conduct and administration of the Contest, including the selection of winners and the distribution of Prizes.

3.     AGREEMENT TO BE LEGALLY BOUND:

By participating in this Contest, each entrant (and, if a Minor, his/her parent or legal guardian) agrees to be bound by (i) these Official Rules; and, (ii) all decisions of the Sponsor and the Contest Administrator, which are final in all respects.

4. HOW TO ENTER:

NO PURCHASE NECESSARY. You will not increase your chances of winning by buying a product because no purchase is required to participate.

To enter the Contest, an Entrant must during the Contest Period (i) visit the Tim Hortons Newsroom website at http://news.timhortons.ca (the “Website”), (ii) follow the on-screen instructions and complete the online form with their full name, date of birth, complete mailing address (including postal code), telephone number (including area code) and email address, and (iii) complying with the Entry Criteria (defined below), submit an answer to the question "Why your street deserves to be decked out by Tims?" in the text box provided (collectively, an “Entry”).

There is a total limit of one (1) Entry per person. In order to be eligible, an Entry must be submitted in accordance with these Official Rules during the Contest Period (which will be determined by the Sponsor in its sole and absolute discretion).

All Entries must meet the following criteria (the “Entry Criteria”):

i. Each Entry must be in English or French, original and may not exceed 250 words in length.

ii. Each Entrant must have all rights necessary to submit his/her Entry. It is each Entrant’s responsibility to ensure that he/she has all necessary rights to submit the Entry. Entries must not infringe on the intellectual property or other rights of any third party.

iii. Entries must be submitted through the Website as per the instructions provided.

iv. Entries must not contain identifying information (e.g., names, addresses, phone numbers, email addresses or mailing addresses) of any real person, including the Entrant.

v. Entries must not contain material that is obscene, lewd, disparaging, defamatory, libelous, threatening, pornographic, sexually explicit, racially or ethnically offensive, or that otherwise contains inappropriate content or objectionable material as determined by Sponsor in its sole discretion, or that encourages conduct that would be considered a criminal offense, give rise to civil liability, or violate any law. Entries must be appropriate for viewing by the general public; appropriateness will be determined by Sponsor at its sole discretion.

vi. Entries must not contain any reference to any competitors of the Sponsor and must not disparage the goodwill and business reputation of Tim Hortons, its affiliates, its franchisees or any of its content licensors.

vii. Entries must be relevant to the Contest theme.

Sponsor reserves the right to reject any Entry for any reason whatsoever.

An Entry will be considered to be void (and an Entry will not be granted) if the Entry: (i) does not meet the Entry Criteria, (ii) is incomplete or illegible; and/or (iii) is not submitted and received during the Contest Period in accordance with these Official Rules (including without limitation the Entry Criteria listed below in Section 4).

All Entries and Entrants are subject to verification at any time and for any reason. The Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor including, without limitation, government issued photo identification) to participate in this Contest. Failure to provide such proof to the satisfaction of the Sponsor within the timeline specified by the Sponsor may result in disqualification. The sole determinant of the time for the purposes of this Contest will be the Contest server machine(s). Entries will not be returned or acknowledged. Entries received from an account associated with any organization, company, corporation, partnership or other entity will be void. An account used to participate in this Contest must be a personal, individual account.

5.     PARTICIPATION CONDITIONS AND REQUIREMENTS:

If it is discovered by the Sponsor at any time (using any evidence or other information made available to or otherwise discovered by the Sponsor) that any person has attempted to: (i) exceed any of the limits or restrictions stated in these Official Rules, or otherwise not complied with these Official Rules; (ii) use multiple accounts, e-mail addresses, names, identities, and/or any automated, macro, script, robotic or other system(s) or program(s) to enter, or to disrupt the Contest; and/or (iii) disrupt or participate in the Contest in any other fraudulent or misleading way, then he/she may be disqualified from the Contest and any Prize(s) won may be revoked all as determined by the Sponsor in its sole and absolute discretion, and without limiting the other remedies available to the Sponsor.

By submitting an Entry (and each individual component thereof), you warrant and represent that the Entry complies with all conditions stated in these Official Rules. The Releasees (defined below) will bear no legal liability regarding the use of an Entry you submit. The Releasees shall be indemnified and held harmless by each Entrant from any loss or claim in connection with such Entrant’s violation of, or non-compliance with, these Official Rules.

Without limiting the generality of Section 4, to be eligible as an Entry in this Contest, such Entry must be unique and original (e.g. an Entrant cannot submit multiple submissions or copy someone else’s written text), any written text must be in English or French and such Entry must be submitted by the Entrant themselves and not by another individual on the Entrant’s behalf.

By participating in the Contest, each Entrant agrees to be legally bound by these Official Rules and by the interpretation of these Official Rules by the Sponsor and further warrants and represents that:

i. the Entry submitted is original to the Entrant and the Entrant has all necessary rights in and to the Entry (including without limitation the Comment) to submit it in connection with this Contest;

ii. the Entry submitted does not violate any law;

iii. the Entry submitted does not contain any reference to any competitors of the Sponsor;

iv. the Entry submitted does not contain any identifiable third parties trademarks, logos or trade dress owned by others unless consent has been obtained from each such corporation;

v. the Entry submitted is not negative or disparaging of the Sponsor, its products, services or personnel; and

vi. the Entry submitted will not give rise to any claims of infringement, invasion of privacy or publicity, or infringe on any rights and/or interests of any third party, or give rise to any claims whatsoever; and is not defamatory, trade libelous, pornographic or obscene, and further that it will not contain, include, discuss or involve, without limitation, any of the following: nudity; alcohol/drug consumption or smoking; explicit or graphic sexual activity, or sexual innuendo; crude, vulgar or offensive language and/or symbols; derogatory characterizations of any ethnic, racial, sexual, religious or other groups; content that endorses, condones and/or discusses any illegal, inappropriate or risky behaviour or conduct; personal information of individuals, including, without limitation, names, telephone numbers and addresses (physical or electronic); commercial messages, comparisons or solicitations for products or services other than products of the Sponsor; any identifiable third party products, trademarks, brands and/or logos, other than those of Sponsor; conduct or other activities in violation of these Official Rules; and/or any other content that is or could be considered inappropriate, unsuitable or offensive, all as determined by the Sponsor in its sole and absolute discretion.

By entering the Contest and submitting an Entry, each Entrant: (i) grants to the Sponsor in perpetuity, a non-exclusive license to publish, display, communicate to the public by telecommunication, make available, reproduce, modify, edit or otherwise use their Entry, in whole or in part, for administering, advertising or promoting the Contest or for any other reason; (ii) waives all moral rights in and to their Entry in favour of the Releasees; and (iii) agrees to release, indemnify and hold harmless the Contest Parties and each of their respective agents, employees, directors, officers, successors, and assigns (collectively, the “Releasees”) from and against any and all claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trademark infringement or any other cause of action that relate in any way to the Entry. For greater certainty, the Sponsor reserves the right, in its sole and absolute discretion and at any time during the Contest, to modify, edit or disqualify any Entry if a complaint is received with respect to the Entry, or for any other reason. If such an action is necessary at any point, then the Sponsor reserves the right, in its sole and absolute discretion, to disqualify the Entry and/or the associated Entrant. If the Sponsor determines, in its sole and absolute discretion, that any Entry does not comply with these Official Rules for any reason at any time, then the Sponsor reserves the right, in its sole and absolute discretion, to disqualify the Entry and/or the associated Entrant.

6.     ELECTRONIC COMMUNICATIONS:

By submitting an Entry to the Contest as described above, the Entrant (the person who submitted the Entry) agrees to communicate with the Sponsor electronically and agrees that the act of submitting the Entry to the Contest is a binding form of your electronic signature, which you agree binds you to these Official Rules.

7.     THE PRIZE AND ITS APPROXIMATE RETAIL VALUE:

There are a total of six (6) prizes, consisting of (i) one (1) grand prize and (ii) five (5) runner up prizes (each a “Prize” and together the “Prizes”), to be won at the start of the Contest with a total approximate retail value (“ARV”) of CAD $ 20,225.

A. GRAND PRIZE

There is one (1) “Deck Your Street with Tim Hortons” grand prize package (a “Grand Prize”) available to be won consisting of: (i) thirty (30) x 8ft x 5ft inflatable festive bears holding an over-sized Tim Hortons cup (each an “Inflatable” and together the “Inflatables”), with an approximate retail value CAD $ 535 each; and (ii) a selection of Tim Hortons hot drinks and baked goods (the “Food and Beverages”), with an approximate retail value of CAD 1,500. The total ARV of a Grand Prize is CAD $17,550.

The Grand Prize will be delivered by the Sponsor to the confirmed winner’s street address for the Event (defined below) on a date and time decided upon by the Sponsor in its sole and absolute discretion.

The Food and Beverages aspect of the Grand Prize must be accepted as awarded in the form solely decided upon by the Sponsor and will be served through a Tim Hortons truck, which will visit the confirmed winner’s street during the Event for a maximum of two (2) hours, or until all the Food and Beverages are depleted, whichever occurs first.

By participating in the Contest, and in order to be confirmed as a winner of a Grand Prize, an Entrant confirms and agrees that he/she will (“Event Criteria”):

i. be solely responsible for hosting an outdoor street party with their neighbours in the evening time on or around December 20, 2021 or December 21, 2021 (the “Event”);

ii. be willing and capable to host the Event, i.e. the confirmed winner will legally have access to a safe outdoor street area in a housing suburb in Canada;

iii. be solely responsible for all the organisation, co-ordination and arrangements in the Event, including: (a) any applicable permits or permissions required by law, by-law, regulation or statute; (b) sending invitations to neighbours, and arranging attendance; (c) installation, power supply and dissembling the Inflatables in their street; (d) any setup/clean up, garbage disposal etc; and (e) any other required organisation, co-ordination and/or arrangements whether or not foreseen, now or in the future;

iv. allow the Sponsor’s agents and camera crew, and if applicable any news agency, to attend the Event to take videos and/or photos of the Event which will be used by the Sponsor for marketing and communications purposes, and the confirmed winner will reasonably assist the Sponsor in causing all of the people attending the Event to sign appropriate use of likeness waiver release forms (to be provided on the day of the Event);

If the confirmed winner does not utilize any part(s) of the Grand Prize for any reason, then any such part(s) not utilized may, in the sole and absolute discretion of the Sponsor, be forfeited in their entirety and, if forfeited, nothing will be substituted in their place.

NOTE: Sponsor reserves the right at any time to: (a) place reasonable restrictions on the availability or use of the Grand Prize or any component thereof; and (b) substitute the Grand Prize or a component thereof for any reason with a prize or prize component(s) of equal or greater value, including, without limitation, but solely at the Sponsor’s sole discretion, a cash award (including without limitation if the fulfillment of the Grand Prize, or any part thereof, is rendered impossible, infeasible, unsafe or impractical for any reason including without limitation due to any pandemic-related law, regulation, order, policy, guideline, strike, travel restriction, venue policy, restriction, inclement weather, any act of God, or for any other reason (all as determined by the Sponsor in its sole and absolute discretion)). By accepting the Grand Prize, the confirmed winner agrees to waive all recourse against the Releasees if the Grand Prize or a component thereof does not prove satisfactory, either in whole or in part.

If so required by the Sponsor, the confirmed winner shall cause its guests to sign (and, if a Minor, his/her parent or legal guardian must also sign) and return the Sponsor’s release (by the date indicated on the release form) indicating that he/she waives all recourse against the Releasees relating to his/her participation in the Grand Prize.

Any difference between the actual value of the Grand Prize and its stated approximate retail value will not be awarded. All characteristics and features of the Grand Prize (and of each Grand Prize element), except as otherwise explicitly stated above, are at the Sponsor’s sole and absolute discretion. Precise arrangements are subject to availability and are at the Sponsor’s sole and absolute discretion. Certain blackout dates and further restrictions may apply. The Releasees will not be in any way responsible (and for greater certainty, are not obligated to offer any substitute prizing) in the event that any part of the Grand Prize is delayed, postponed, rescheduled or cancelled for any reason whatsoever (including, without limitation, due to illness or health risks, or any governmental or health authority orders, measures, directives or guidance in response to such illness or risks, such as, without limitation, those that may be implemented to mitigate COVID-19 transmission, or due to any other cause of any kind or nature whatsoever).

The Sponsor reserves the right to change any of the Grand Prize dates and/or Grand Prize description at its sole and absolute discretion. Sponsor reserves the right to revoke any full or partial Grand Prize from the winner or winner’s guest who it, or its personnel, deem may, in their sole discretion, be intoxicated, be a safety risk, have violated any policy or law, or may bring Sponsor or any of the other parties into disrepute.

B. RUNNER UP PRIZES

There are five (5) runner up prizes (each a “Runner Up Prize” and together the “Runner Up Prizes”) available to be won. Each Runner Up Prize consists of one (1) x 8ft x 5ft inflatable festive bears holding an over-sized Tim Hortons cup (an “Inflatable”), with an approximate retail value CAD $ 535 each. For greater certainty and the avoidance of doubt, there is one (1) Runner Up Prize available per winner and the Sponsor shall in its sole and absolute discretion decide which Runner Up Prize is awarded to the respective winners (i.e. a winner will not be able to choose which available Runner Up Prize they wish to be awarded). The total ARV of the Runner Up Prizes is CAD 2,675.

Without limiting the foregoing, the following general terms and conditions apply to all Prizes: (i) all values set above are based on approximate prize values in Canada at the time of preparing these Official Rules; (ii) all characteristics and features of each Prize, except as otherwise explicitly stated above, will be determined by the Sponsor in its sole and absolute discretion; (iii) each Prize must be accepted as awarded and is not transferable, assignable or (as applicable) convertible to cash (except as may be specifically permitted by Sponsor in its sole and absolute discretion); (iv) no substitutions are permitted, except at Sponsor’s option and as may be specifically permitted by Sponsor in its sole and absolute discretion; (v) Sponsor reserves the right at any time to: (a) place reasonable restrictions on the availability or use of a Prize or any component thereof; and (b) substitute a Prize or a component thereof in case of unavailability of any Prize, to accommodate for a disability, or for any reason, with a prize or prize component(s) of equal or greater retail value, including, without limitation, but solely at the Sponsor’s sole discretion, a cash award; (vi) Prize winners are solely responsible for all costs not expressly described herein; (vii) redemption of each Prize must occur within and/or on or before the date or dates specified by the Sponsor (otherwise the Prize may, in the sole and absolute discretion of the Sponsor, be forfeited in its entirety and, if forfeited, nothing will be substituted in its place); (viii) if the confirmed winner does not utilize any part(s) of the Prize, then any such part(s) not utilized may, in the sole and absolute discretion of the Sponsor, be forfeited in their entirety and, if forfeited, nothing will be substituted in their place; (ix) by accepting a Prize, each confirmed winner (or, if the winner is a Minor, his/her parent or legal guardian) acknowledges that the Releasees have not made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any Prize, including but not limited to its quality, mechanical condition or fitness for a particular purpose; (x) all approximate retail values do not include applicable goods and services tax, provincial, territorial or sales and use taxes, confirmed winners may be required to pay such taxes upon receipt of the applicable Prize; (xi) if a potential Prize winner is a Minor, the applicable Prize will be awarded to such Minor's parent or legal guardian (subject to compliance with these Official Rules); (xii)  by accepting a Prize, the confirmed winner agrees to waive all recourse against the Releasees if the Prize or a component thereof does not prove satisfactory, either in whole or in part; and (xiii) the Releasees will not be responsible for any lost, stolen or damage, either in whole or in part, of a Prize, or a component thereof.

Resale of a Prize or any aspect(s) therefore of is prohibited.

8. WINNER SELECTION:

Ten (10) finalists will be selected by a panel of Contest Administrator staff members from all eligible Entries received, on or about December 8, 2021, based equally on merit and originality (50% / 50%). Sponsor and/or Contest Administrator reserves the right to select fewer than ten (10) finalists if, at its sole discretion, it does not receive a sufficient number of eligible and qualified Entries.

Prior to selecting a potential winner, the Sponsor may itself, or through its designated representative, contact the Entrants selected as finalists either by email and/or by phone (using the information provided by the potential winner at the time of entry) to confirm their eligibility to win a Prize and to confirm compliance with these Official Rules, including the Event Criteria. The Sponsor reserves the right, in its sole and absolute discretion, to disqualify any Entrant at any time for any reason whatsoever, including if, in the Sponsor’s opinion, the Entrant is not able to comply with these Official Rules or the Event Criteria should they be declared a winner of a Prize.

Judging scores will not be revealed. The decisions of judges are final.

The odds of winning the Prize will depend on the number of eligible Entries received during the Contest Period.

9. CONTACTING OF POTENTIAL WINNER:

One (1) potential Grand Prize winner and five (5) Runner Up Prize winners will be selected through a skills-based judging process on or about on December 8 2021, at 11:00:00 A.M, EST at 50 Carroll Street, Suite 117, Toronto, Ontario, M4M 3G3 from among all eligible Entries received during the Contest Period from a selection of (10) potential Prize winners.

The Sponsor or its designated representative will make a minimum of two (2) attempts to contact each potential Prize winner  by email and/or by phone (using the information provided by the potential winner at the time of entry) within three (3) days from the winner selection date. The potential Prize winner must respond by either direct message or by email within the forty eight (48) hours after receiving the notification. If the potential winner cannot be contacted within such time, or if there is a return of any notification as undeliverable; then he/she may, in the sole and absolute discretion of the Sponsor, be disqualified (and, if disqualified, will forfeit all rights to the applicable Prize); the Sponsor reserves the right to award forfeited prizes to the next eligible winner.

After the winner of a Grand Prize has been confirmed, the Sponsor or its designated representative will send make a minimum of two (2) attempts to contact confirmed winner by email and/or by phone (using the information provided by the potential winner at the time of entry) to arrange for a specified date and time for the Event. If the potential winner cannot be contacted within one week (1) before the Event date (i.e. a week before December 20 or December 21, 2021), or if there is a return of any notification as undeliverable; then he/she may, in the sole and absolute discretion of the Sponsor, be disqualified (and, if disqualified, will forfeit all rights to the applicable Grand Prize); the Sponsor reserves the right to award forfeited prizes to the next eligible winner.

10. BEFORE BEING DECLARED THE CONFIRMED PRIZE WINNER, a potential Prize winner will be required to: (a) correctly answer a mathematical skill-testing question without mechanical or other aid; and (b) sign and return a Prize release within the timelines specified by the Sponsor, pursuant to which the potential Prize winner: (i) confirm compliance with these Official Rules; (iii) provide the Sponsor or its designated agent with his/her first and last name, complete mailing address including postal code, email address, date of birth and telephone number; (iv) acknowledge acceptance of the Prize as awarded; (v) acknowledge acceptance of the Event Criteria (vi) assign all intellectual property, including copyright, in and to their Entry and waives his/her moral rights therein in favour of the Sponsor; (vii) agree to indemnify the Releasees against any and all claims, damages, liabilities, costs, and expenses arising from use of his/her Entry including, without limitation, any claim that the Entry infringes a proprietary interest of any third party; (viii) release the Releasees from any and all liability in connection with the Contest, his/her participation therein and/or the awarding and use/misuse of the Prize or any portion thereof; and (ix) agree to the publication, reproduction and/or other use of his/her name, photograph, voice, statements about the Contest and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by or on behalf of the Sponsor in any manner whatsoever, including print, broadcast or the internet, worldwide and in perpetuity. If the potential Prize winner fails to correctly answer the skill-testing question, provide the Sponsor with their full contact information, sign and return the Prize release, cannot accept the Prize as awarded for any reason, cannot accept and fulfill the Event Criteria for any reason whatsoever or otherwise violates these Official Rules (as determined by the Sponsor in its sole and absolute discretion), they will be disqualified and will forfeit all rights to the Prize.

11. GENERAL CONDITIONS:

By participating in this Contest, each Entrant: (i) agrees to be bound by these Official Rules; (ii) agrees to release, indemnify and hold harmless the Releasees from and against any and all claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trademark infringement or any other cause of action; and (iii) releases the Releasees from any and all liability in connection with this Contest and their participation therein. ANYONE DEEMED BY THE SPONSOR TO BE IN VIOLATION OF THE LETTER AND/OR SPIRIT OF THESE OFFICIAL RULES FOR ANY REASON IS SUBJECT TO DISQUALIFICATION IN THE SOLE AND ABSOLUTE DISCRETION OF THE SPONSOR AT ANY TIME.

The Releasees will not be liable for: (i) any failure of the Website, and/or any Sponsor website during the Contest; (ii) any technical malfunction or other problems relating to the telephone network or lines, computer on-line systems, servers, access providers, social platforms, computer equipment or software; (iii) the failure of any Entry to be received for any reason including, but not limited to, technical problems or traffic congestion on the Internet or at the Website, or any Sponsor website or mobile network; (iv) any injury or damage to an Entrant’s or any other person’s computer or other device related to or resulting from participating or downloading any material in the Contest; and/or (v) any combination of the above.

The Sponsor reserves the right, subject only to the approval of the Régie des alcools, des courses et des jeux (the “Régie”) in Quebec, to withdraw, amend or suspend this Contest (or to amend these Official Rules) in any way, in the event of an error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure or any other cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of this Contest as contemplated by these Official Rules including, without limitation, any error, problem, computer virus, social platform error, bugs, tampering, unauthorized intervention, fraud or failure of any kind whatsoever. Any attempt to deliberately damage the Website or any Sponsor website or to undermine the legitimate operation of this Contest in any way (as determined by Sponsor in its sole and absolute discretion) is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law. The Sponsor reserves the right, with the consent of the Régie, to cancel, amend or suspend this Contest, or to amend these Official Rules, without prior notice or obligation, in the event of any accident, printing, administrative, or other error of any kind, or for any other reason, and the Sponsor reserves the right, in its sole and absolute discretion, to conduct a random draw from amongst all eligible Entries received.

For Quebec residents: Any litigation respecting the conduct or organization of a publicity contest may besubmitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the board only for the purpose of helping the parties reach a settlement.

This Contest is subject to all applicable federal, provincial and municipal laws. The decisions of the Sponsor with respect to all aspects of this Contest are final and binding on all Entrants without right of appeal, including, without limitation, any decisions regarding the eligibility/disqualification of Entrants and/or Entries.

The Sponsor reserves the right subject only to the approval of the Régie in Quebec, and without prior notice, to adjust any of the dates and/or timeframes stipulated in these Official Rules, to the extent necessary, for purposes of verifying compliance by any Entrant or Entries with these Official Rules, or as a result of any technical or other problems, or in light of any other circumstances which, in the opinion of the Sponsor, in its sole and absolute discretion, affect the proper administration of the Contest as contemplated in these Official Rules, or for any other reason. In no event will the Sponsor be liable for more than the stated number of prizes available to be awarded.

By entering this Contest, each Entrant expressly consents to the Sponsor, its agents and/or representatives, storing, sharing and using the personal information submitted with their Entry for the purpose of administering the Contest and in accordance with Sponsor’s privacy policy (available at https://www.timhortons.ca/privacy-policy), unless the Entrant otherwise agrees.

In the event of any discrepancy or inconsistency between the terms and conditions of these English Official Rules and disclosures or other statements contained in any Contest-related materials, including, but not limited to: website and/or point of sale, television, print or online advertising; French version of these Official Rules, and/or any instructions or interpretations of these Official Rules given by any representative of the Sponsor; the terms and conditions of these English Official Rules shall prevail, govern and control to the fullest extent permitted by law.

The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with the terms as if the invalid or illegal provision were not contained herein.

To the fullest extent permitted by applicable law, all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of participants, Sponsor or any of the other the Releases in connection with the Contest will be governed by and construed in accordance with the domestic laws of the Province of Ontario and the federal laws of Canada applicable therein, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction’s laws. The parties hereby consent to exclusive jurisdiction and venue of the courts located in Ontario in any action to enforce (or otherwise relating to) these Official Rules or relating to this Contest.
